Who has to justify a dismissal that follows a PIP?
If you are eventually dismissed for poor performance, your employer still carries the burden of showing the dismissal was for just cause or excuse, not just that a PIP existed1.
A PIP with unclear or shifting targets can work against your employer later, since it suggests the process was not genuinely fair, which strengthens an unfair dismissal claim.
What should you keep during the PIP period?
Save every version of the plan, including any changes to the targets, and the date each version was issued to you.

Common questions
Can I refuse to sign the PIP document?
You can decline to sign while still engaging with the plan in good faith, and note your concerns in writing instead. Refusing to sign does not usually protect you on its own, so documenting your objections matters more than the signature.
What if I genuinely was underperforming?
A fair process still matters even if there were real performance issues. What a lawyer looks at is whether the process used to address it, and the eventual dismissal, was handled reasonably and consistently with how others were treated.
How long should a PIP normally last?
There is no single fixed length in Malaysian law, so look at whether the timeline given was realistic for the targets set. A very short window for significant improvement is one sign the plan may not be genuine.
Should I ask HR for a copy of the company's PIP policy?
Yes, if one exists, since it tells you what the company's own process is supposed to look like. A PIP that departs significantly from the written policy can support a claim that it was not applied fairly.
