Retrenchment and the selection question

A genuine retrenchment in a Selangor factory should still follow the usual practice.1 The most recently hired staff in the affected category go first.

If you were retrenched ahead of newer colleagues, that gap is worth raising. Higher earning staff in Cyberjaya offices are not excluded either.2

Where the case actually goes

Common questions

My factory in Shah Alam picked me for retrenchment. Can I ask why I was chosen over newer staff?

Yes. The usual principle is that the most recently hired staff in your category go first, and an employer needs a reason to depart from that order. Keep your hire date and any list of who was retrenched, since that comparison matters.

I earn a good salary at a Cyberjaya tech company. Does that put me outside this process?

No. The Section 20 route covers workmen regardless of a higher salary, even though some Employment Act protections are wage capped separately. A well paid Selangor employee can still bring an unfair dismissal claim.

Why does my Selangor case go through a Kuala Lumpur division instead of a court in Selangor?

Selangor does not have its own Industrial Court branch, so cases from the state are heard through the nearest branch, which sits in Kuala Lumpur. The JPPM office for Selangor still handles the conciliation stage before any referral.
