Dismissed From a Job in Penang

A Bayan Lepas factory layoff and a George Town cafe closure both start the same sixty day count.

Penang runs on two very different economies. There is electronics manufacturing in the Bayan Lepas free industrial zone, and tourism and hospitality in George Town’s heritage core.

Both feed into the same Section 20 process. Both are heard through Penang’s own Industrial Court branch.

Bayan Lepas and George Town are not the same story

Production line workers in Bayan Lepas tend to face formal retrenchment exercises. This usually happens when a factory scales down or shifts a product line elsewhere.

Hospitality and retail staff around George Town’s heritage streets more often face sudden terminations. These are tied to slow tourist seasons or a change in ownership.

The paperwork looks different in each case. The deadline and the route to the Industrial Court do not.

The Penang Bridge connects the island to a mainland manufacturing belt in Seberang Perai. Workers there face a similar retrenchment pattern to Bayan Lepas, just on the other side of the strait.

What the retrenchment rules ask of an employer

A genuine Bayan Lepas retrenchment should still follow the usual practice.1 The most recently hired staff in a category go first, unless the employer has a real reason to depart from it.

If a more senior colleague was kept on ahead of you, that comparison belongs in your evidence.

A genuine redundancy also has to reflect a real drop in work, not just a convenient label for removing one person.

Employment Act protections since January 2023 matter here too, including the rule against dismissing a pregnant worker.2

Filing from Penang

Conciliation for a Penang case runs through the JPPM office for the state. A referral that does not settle goes to the Industrial Court’s Penang branch, not Kuala Lumpur.

Set your exact last working day first. Then run it through the deadline calculator to see your filing date.

An employment lawyer can help once your documents are in order, whether a retrenchment letter or a termination notice.

A short message about your role, on a production line or behind a counter, helps us point you the right way.

Whether your job was on a Bayan Lepas production line or in a George Town shop, share your dates and we can talk through what fits your case.

Common questions

My electronics factory in Bayan Lepas retrenched a batch of production staff. What should we be checking?

Start by comparing hire dates within your job category, since the usual principle is that the most recently hired staff go first unless the employer has a real reason to depart from it. A shared retrenchment list among affected colleagues can be useful evidence.

I was let go from a George Town cafe shortly after telling my employer I was pregnant. Does that matter?

It can matter a great deal. Employment Act protections against dismissing a worker because she is pregnant took effect from January 2023, and that timing is worth setting out clearly in your representation alongside your other facts.

Does Penang's Industrial Court branch only handle Bayan Lepas factory cases?

No. The Penang branch hears unfair dismissal claims from across the state, whether the job was on a Bayan Lepas production line or in a George Town shop or hotel. The same JPPM office and court branch cover both.
