How This Court Actually Runs Your Case
You have a court date coming up and want to know what the process actually looks like.
The word court can sound more intimidating than the actual process turns out to be, especially in the early stages of a dismissal case.
How does a case actually reach this stage?
A case arrives at the Industrial Court after conciliation fails and the Director General of Industrial Relations refers it forward for a hearing.
From there, the process moves through filings from both sides before the substance of the dismissal is actually argued.
What happens at the early procedural dates?
Early appearances, often called mentions, are largely used to check on filing progress, confirm timelines, or set the date for the next step.
They are not the stage where your dismissal is argued in full, so detailed evidence and arguments usually come later, at the actual hearing.
Where is a case actually heard?
The court is headquartered in Kuala Lumpur, with branches in Penang, Ipoh, Johor Bahru, Kota Kinabalu and Kuching.1
A case is generally heard at the branch nearest to where you worked, which is worth confirming early so you know where to expect your dates.
What role does a lawyer play at each stage?
Solicitors are not permitted to represent either party at the earlier conciliation stage, which happens before a case ever reaches the court itself.
